Magical Coloring Book allows users to upload photos and transform them into coloring book pages using AI technology. We offer digital downloads and physical printed books.

3. Account Registration

To use our Service, you must:

• Create an account with accurate information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Acceptable Use Policy

Prohibited Content

You may NOT upload images containing:

• Nudity or sexual content
• Graphic violence or gore
• Illegal activities
• Child exploitation material
• Hate speech or discriminatory content
• Content that violates others' privacy

Your Responsibilities

By uploading images, you represent and warrant that:

• You own or have the rights to use the uploaded content
• Your content doesn't violate any laws or third-party rights
• Your content complies with our content policies

Our Rights

We reserve the right to:

• Remove content that violates these Terms
• Terminate accounts for violations
• Report illegal content to appropriate authorities
• Review uploaded content for compliance

5. Intellectual Property

Your Content

• You retain ownership of original photos you upload
• You retain copyright to coloring pages generated from your photos
• You grant us a license to use your content solely to provide the Service (processing, storing, printing, shipping)

Permitted Use of Generated Content

You may:

• Use coloring pages for personal and commercial purposes
• Share, distribute, or display your coloring pages
• Create derivative works from your coloring pages

You may NOT:

• Resell the generated coloring pages as-is in direct competition with our Service
• Claim our Service or technology as your own

Third-Party Content

If you upload images containing third-party intellectual property (e.g., copyrighted characters), you are solely responsible for any legal consequences.

6. Pricing and Payment

• Current prices are displayed on our website
• All payments are processed securely through Stripe
• We do not store or have access to your payment information
• Prices may change at any time for future orders
• Prices are in US dollars

7. Refunds and Cancellations

Digital Orders

• We'll retry generation ONCE if results are unsatisfactory (contact us at magicalcoloringbook@gmail.com)
• Generally no refunds unless extenuating circumstances
• All sales are final once you've downloaded your coloring pages

Physical Orders

• Partial refunds available for the physical product cost only
• Digital portion is non-refundable
• Damaged products: Contact us at magicalcoloringbook@gmail.com and we'll try to help

8. Service Limitations

• Maximum file size: 4 MB
• Supported formats: PNG, WEBP, JPG
• We use OpenAI technology which may occasionally produce unexpected results
• Service availability depends on our hosting provider (Railway) and third-party services
• Images are stored on Microsoft Azure infrastructure
• We use Sentry for error monitoring and service debugging

9. Privacy

Your use of our Service is also governed by our Privacy Policy.

10. Disclaimers and Limitations of Liability

Service Provided "As Is"

The service is provided "as is" without warranties of any kind, express or implied.

Limitation of Liability

To the maximum extent permitted by law, Magical Coloring Book shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Any damages exceeding the amount you paid us in the past 12 months

Your Indemnification

You agree to indemnify and hold harmless Magical Coloring Book from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your uploaded content

11. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violating these Terms
• Uploading illegal content
• Repeated violations of content policies
• Any other reason at our sole discretion

Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may modify these Terms at any time. If we make material changes, we'll notify you by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of Delaware, without regard to conflict of law principles.

Any disputes should first be addressed by contacting us at our support email. We'll do our best to resolve issues informally.

If we can't resolve a dispute informally, any legal proceedings shall be brought solely in the state or federal courts located in Delaware, and you consent to personal jurisdiction in these courts.

These Terms constitute the entire agreement between you and Magical Coloring Book.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

No Waiver

Our failure to enforce any right or provision isn't a waiver of that right.

Assignment

You may not assign these Terms without our consent. We may assign our rights to any successor or buyer.
